Current 2026 Code Overview, Recent Legislative Revisions, and Officiant Obligations
Every district or circuit court judge, district court commissioner, supreme court justice, magistrate, and every licensed or ordained minister of the gospel, bishop, priest, or rabbi, or other qualified person acting in accordance with the traditions or rites for the solemnization of marriage of any religion, denomination, or religious society, may perform the ceremony of marriage in this state. No particular form is required, except that the parties shall solemnly declare in the presence of the person performing the ceremony and at least two (2) attending witnesses that they take each other as husband and wife.
Under legislative updates, the general minimum age to marry is 18 years old. All marriages involving persons under sixteen (16) years of age require strict judicial approval from a court of record along with parental or guardian consent. Prior broad exceptions allowing younger marriages have been formally revised and tightened.
Every person who performs a marriage ceremony shall certify to the facts of the marriage and file the record with the county clerk who issued the license within ten (10) days after the ceremony. Marriage licenses obtained from a Wyoming county clerk expire one (1) year from the date of issuance if not solemnized.
If any county clerk neglects to record a marriage certificate, or if any person performs a marriage ceremony knowing that they are not legally authorized to do so or knowing of any legal impediment to the proposed marriage, they are guilty of a misdemeanor and shall be punished by a fine not exceeding five hundred dollars ($500) or imprisonment for not exceeding one year.
